The Hill School (the “School”) is a non-profit school that, from time to time, allows third parties to utilize its property, buildings, equipment, and other premises (the “Facilities”) for a variety of activities.  As a condition of making its Facilities available to Baseball Skills on The Hill Camp, this Facilities Use Participant Waiver Form (the “Form”) must be signed by any individuals or their parents/guardians if they are a minor, who participates in an activity hosted by Baseball Skills on The Hill Camp at the School’s Facilities (“Participant”).

I. PARTICIPATION AND USE OF THE FACILITIES

I, the undersigned, hereby acknowledge that I/Participant will be participating in Baseball Skills on The Hill Camp at the School (the “Activity”).  If I am signing this Form on behalf of a minor child, I give my consent and approval for that minor child to participate in the Activity.  I understand that the School has not organized and will not be supervising the Activity. I have received information from Baseball Skills on The Hill Camp that is sufficient to inform myself about the Activity, including any safety risks associated therewith.  I agree that I/Participant will use the Facilities in a safe manner, consistent with any applicable directions and instructions given.

II. WAIVER OF LIABILITY

I recognize and acknowledge that use of the Facilities and participation in the Activities may involve significant risks of injury.  These risks include, but are not limited to, serious bodily injury, permanent disability, concussions, brain trauma, neck and spinal injuries, broken bones, sprains or strains, joint or ligament damage, paralysis, infection with communicable illnesses, psychological injuries, damage to or theft of property, and even death.  I recognize and acknowledge the possibility of additional risks of which neither the School nor I may be aware.  I represent and warrant that I am enrolled in any and all insurance, including, but not limited to, healthcare, accident, and personal property insurance, that I believe, in my sole judgment, are necessary for my/Participant’s use of the Facilities.

In consideration of being permitted to use the Facilities, I acknowledge, understand, and agree to the following terms:

A. RELEASE.  On behalf of myself and, as applicable, Participant and my/our heirs, executors, administrators, personal representatives, and/or assigns (“Releasors”), I agree to forever release, waive, acquit, discharge, covenant to hold harmless, and covenant not to sue the School, its trustees, employees, representatives, agents, insurers, attorneys, volunteers, and all others related to or associated with the School (the “Releasees”) from any and all claims, suits, liabilities, actions, and causes of action which I/Participant or my/our heirs, legal representatives, successors, and assigns may have, now or in the future, which arise directly or indirectly out of the Activity or the use of the Facilities.

B. ASSUMPTION OF RISK.  I fully understand that using the Facilities may involve risks and danger of serious bodily injury and damage to property, including those risks identified above.  While rules, equipment, and personal behavior may reduce the likelihood of injury, the risks and dangers of bodily injury still remain.  On behalf of myself and, as applicable, Participant, I knowingly and freely assume all risks, both known and unknown, associated with the Activity or use of the Facilities, including, but not limited to, bodily injuries and damage and loss of property.

C. INDEMNIFICATION.  I hereby agree to indemnify Releasees from and against any and all demands, claims, suits, actions, causes of action, including, but not limited to, claims of negligence, and any other liabilities, including attorneys’ fees, by any person resulting directly or indirectly from my/Participant’s use of the Facilities, including, but not limited to, injury of any person or damages or destruction to any property caused by me/Participant.

The release, assumption of risk, and indemnification provisions set forth above include any property or personal loss or damage, or other loss caused or alleged to be caused, in whole or in part, by the negligence (but not gross negligence) of the Releasees.
